High court won't order release of father facing charges in infant daughter's death (Lincoln, Nebraska)

For some reason, Peterson was the "sole caretaker parent" when this child was murdered and buried, and yet I have NEVER seen any explanation as to why. But this is typical, I'm afraid.

Neb. high court won't order father's release

LINCOLN, Neb. (AP) - The Nebraska Supreme Court will not order the release of a man facing charges in his infant daughter's death.

The high court on Friday dismissed a request from Lucas Peterson's attorneys seeking the 25-year-old's release. They've said his Sept. 24 arrest was illegal.

Peterson has been charged with child abuse resulting in death and unlawful burial.

Peterson was arrested within hours of the court's Sept. 24 decision allowing charges in his case despite a deal with prosecutors.

But his attorneys have said the high court holds jurisdiction over cases it rules in for at least 10 days before they are sent back to a lower court. So, a Seward County district judge didn't yet have the authority to order Peterson's arrest.
