The father of an infant child will spend time behind bars and time on probation for abusing the little girl.

Christopher Murray Upshaw, 21, of Marion recently pleaded guilty in McDowell County Superior Court to three counts of felony child abuse inflicting serious injury.

On one count, Judge Laura J. “Suzy” Bridges sentenced Upshaw to six to eight months in prison. On the other two counts, the judge handed him a six- to eight-month suspended sentence and placed him on supervised probation for 36 months. He must serve nine months on intensive supervised probation, pay a $500 fine and court costs and perform 72 hours of community service.

Detective Jennifer Trantham of the McDowell County Sheriff’s Office charged Upshaw. Capt. Shanon Smith said the mother of the 3-month-old victim took the baby to the health clinic in early April after “observing signs that something wasn’t right with the child.”

The baby was later transferred to Memorial Mission Hospital in Asheville.

Smith stated that Upshaw admitted to abusing the child three times. She suffered head and brain injuries, often referred to as Shaken Baby Syndrome.
